1. Introduction and Acceptance of Terms

By accessing or using the FrontDesk360 AI website (FrontDesk360.io) or any related services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use this site or its services. FrontDesk360 AI reserves the right to update these Terms of Service at any time without prior notice. Your continued use of the website or services after any changes are posted constitutes your acceptance of the revised terms.

2. Service Description

FrontDesk360 AI provides an AI-powered inbound phone agent and optional add-on services for appointment-based and service-dispatch businesses. The core service answers inbound calls, responds to approved company questions, schedules and manages appointments, transfers calls, and takes messages. Optional add-ons include a company-trained GPT website chatbot and an outbound AI calling service that is manually initiated by authorized staff.

FrontDesk360 AI features and integrations depend on software compatibility, configuration, selected plan, and approved business workflows.

3. Software Compatibility and Configuration Disclaimers

FrontDesk360 AI works with compatible scheduling, booking, CRM, dispatch, and field-service software platforms, but does not guarantee compatibility with every platform. Software compatibility and available functions are confirmed during consultation and setup. Custom programming or third-party integrations may require additional fees. Features and available functions depend on the customer's software, selected plan, and approved configuration. The customer is responsible for providing accurate information about their current software environment prior to setup.

4. No Guarantee Policy

FrontDesk360 AI does not guarantee specific outcomes including but not limited to: guaranteed savings, guaranteed revenue increases, guaranteed appointment volume increases, guaranteed answer rates, or guaranteed compatibility with any third-party software platform. Performance of the AI agent depends on configuration, call volume, customer behavior, software integrations, and other factors outside FrontDesk360 AI's control. Results will vary by business.

5. Outbound AI Calling — Manual Initiation Requirement

Outbound AI calls are manually initiated by authorized staff members of the customer's business. Outbound calls are not automatic, scheduled, or triggered without human authorization. FrontDesk360 AI does not guarantee delivery of outbound calls and is not responsible for regulatory compliance requirements related to outbound calling (including but not limited to TCPA, state telemarketing laws, or do-not-call regulations). The customer is solely responsible for ensuring their use of outbound calling complies with all applicable laws and regulations.

6. Acceptable Use

Users and customers may not use FrontDesk360 AI services for any unlawful purpose, including but not limited to: harassment, fraud, deceptive practices, unauthorized data collection, or any use that violates federal, state, or local law. Customers may not attempt to reverse-engineer, copy, resell, or sublicense the FrontDesk360 AI system without written permission. FrontDesk360 AI reserves the right to suspend or terminate service for violations of acceptable use.

7. AI Disclosure

FrontDesk360 AI operates using artificial intelligence voice and language technology. Callers interacting with the AI phone agent and users interacting with the website chatbot are communicating with an AI system, not a human representative. FrontDesk360 AI recommends that customers disclose the use of AI to their own customers as appropriate and in compliance with applicable laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FrontDesk360 AI, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service, including lost profits, lost revenue, missed appointments, or data loss. FrontDesk360 AI's total cumulative liability shall not exceed the total fees paid by the customer in the three months immediately preceding the event giving rise to the claim.

9. Intellectual Property

All content, branding, configuration tools, AI agent logic, and technology provided by FrontDesk360 AI remain the intellectual property of FrontDesk360 AI. Customer-provided business information used to configure the agent remains the property of the customer. FrontDesk360 AI does not claim ownership of customer business data or proprietary information provided for configuration purposes.

10. Privacy

Use of FrontDesk360 AI services is also governed by the FrontDesk360 AI Privacy Policy. By using this service, customers and users agree to the collection and use of information as described in the Privacy Policy.

11. Termination of Service

Either party may terminate service by providing written notice in accordance with the customer's service agreement. FrontDesk360 AI reserves the right to suspend or terminate service immediately for violations of these Terms of Service, non-payment, or misuse of the platform. Upon termination, customer-provided business configuration data will be handled per the Privacy Policy.

12. Changes to These Terms

FrontDesk360 AI may update these Terms of Service at any time. Changes will be posted to this page with an updated effective date. Continued use of the service after updates constitutes acceptance of the revised terms. Customers are encouraged to review these terms periodically.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which FrontDesk360 AI operates. Any disputes shall be resolved through binding arbitration or in the courts of the governing jurisdiction, as applicable.
